SMS Marketing Policy

TCPA compliance (SMS Marketing): Any TCPA-covered marketing activity (including SMS or text-based marketing, calls made using an “automated telephone dialing system), and calls that include an automated voice must be done only where the consumer has provided prior express written consent, and must comply with the following guidelines:

i. Telemarketing calls (live voice) require the caller to state his or her name, the name of the business, and a telephone number or address of the business;
ii. Transmit aCaller ID that is not spoofed;
iii. Only make calls during times allowed by federal or state law,
iv. Not make calls to any number on the Do-Not-Call Registry(unless consent is received after such Do-Not-Call registration);
v. Include “STOP” instructions in each SMS marketing message; vi.Honor any reasonable opt-out, stop and unsubscribe requests; and
vii. Honor specific Do-Not-Call requests.

Requests for Opt-Out

Opt-IN Flow

  • When customers input a phone number, we send an SMS with an opt-in confirmation. There is an option to opt-out.
  • Customer agree to receive marketing messages in a consent form, and we keep a record.
  • When customers complete a web form, there is a final step where they agree to receive marketing messages in a consent form, and we keep a record.

Opt-OUT Option

We provide all customers with the information on how to opt-out. Each SMS or text message includes:

Compliant Language for Marketing SMS

All materials and content do not and will not include any material that:

  • is inappropriate, such as drug references, profane language, the promotion of drug use, or references to gambling;
  • is obscene, unlawful, or defamatory;
  • violates third party rights or intellectual property rights;
  • is misleading, false, or is likely to deceive or mislead (including, without any limitation, info relating to the author or source of the message);
  • contains images that are sexually explicit;
  • promotes discrimination or violence;
  • assists illegal activities;
  • promotes or advertises a carrier’s competitors if it is delivering the content to a consumer via a specific carrier.
